Purchases made via this website are subject to the following terms and conditions of sale.

Eligibility to purchase

In order to make a purchase through this website, you will be requested to provide personal details. In particular, customers must provide their real name, phone number, e-mail address and other requested information as indicated. Furthermore, when ordering items you will be required to provide payment details, you represent and warrant that the payment details you provide on ordering are both valid and correct, and you confirm that you are the person referred to in the billing information provided.

Stock

Representatives do not accept any responsibility for any lack of stock of any of the products displayed. In the event that ordered items are out of stock, you shall be informed by e-mail and any payment will be refunded if the payment was already processed.

Order confirmation

Once you have made your choice and your order has been placed, you will receive an e-mail message from PayPal confirming that your order has been registered. This order confirmation will include the terms and conditions of your purchase, including information such as the identification of the items purchased and the total price (including taxes and shipment cost). This order confirmation is part of your agreement with DOWNTOWN GRILL.

Failure to receive this message may be due to temporary communications problems with the network or to a mistake when writing the e-mail address. In both cases, please contact customer service at info@downtowngrill.com. We reserve the right not to accept your order in the event, for instance, that we are unable to obtain authorization for payment, that shipping restrictions apply to a particular item or that the item ordered is out of stock. In the event that ordered items are out of stock, you shall be informed by e-mail and any payment will be refunded if it had already been processed.

Pricing policy

Prices shown on this website are in Canadian dollars (CAD). All prices and offers remain valid as advertised from time to time. The price of a product displayed on this website at the time the order is submitted will be honored. DOWNTOWN GRILL INC. will not be responsible for any special duties, custom duties or additional costs for deliveries. DOWNTOWN GRILL INC. reserves the right to modify its retail prices at any time, except for orders that already have been made.

Payment methods and security

We accept orders at any time, 24 hours a day, every day of the week, subject to the website being available.

DOWNTOWN GRILL INC. will only accept payments as shown on the payment page. No other form of payment other than those mentioned before will be accepted.

You confirm that the credit card that is being used is yours or that you have been specifically authorized by the owner of the credit card to use it. All credit card holders are subject to validation checks and authorization by the card issuer. If the issuer of your payment card refuses to authorize payment to DOWNTOWN GRILL INC., we will not be liable for any delay or non-delivery.

We take all reasonable care to make this website secure. In order to ensure secure payment transactions, DOWNTOWN GRILL INC. uses a secured payment system, PayPal. This means that all confidential data (e.g. credit card number and expiry date) are encrypted and transmitted directly, using Secure Socket Layer (SSL) technology, to a secured server.

Furthermore, we will take all reasonable care, insofar as it is in our power to do so, to keep the details of your order and payment secure, but in the absence of negligence on our part we cannot be held liable for any loss you may suffer if a third party procures unauthorized access to any data you provide when accessing or ordering from this website.

DOWNTOWN GRILL INC. will not accept any responsibility for delays in delivering merchandise resulting from lack of authorization by the bank.

DOWNTOWN GRILL INC. reserves the right to withhold any order for security reasons. Customers affected will be notified. We also reserve the right to cancel an order if we cannot verify the shipment and/or billing details, but we shall notify you if this happens. We further reserve the right not to accept and/or cancel an order if we believe the buyer is obtaining the items for resale. In each case above, you will be informed by email and any payment will be refunded if it had already been processed.

Purchase limitations

Customers wishing to buy more than five Electric Hibachi grills must contact the customer service department of DOWNTOWN GRILL INC., where they will be given detailed information about purchasing options.

The products offered for sale and sold through this website are intended for personal use only, and not for resale. By placing an order through this website, you warrant that you are purchasing the product only for personal use. DOWNTOWN GRILL INC., in its sole discretion, reserves the right to refuse to fill any orders which it believes are intended for resale.

Purchase guarantee

We will only be able to fulfill an order if the delivery address is accurate, and a usual place of residence or place of employment located in Canada or in United States.

Deliveries and insurance

DOWNTOWN GRILL INC. insures each purchase during the time it is in transit until it is delivered to your specified delivery address. All orders are delivered by international courier companies.

Deliveries will be made to any usual place of residence or place of employment located in Canada or the United States. All deliveries must be signed for on receipt. Once the items have been signed for, they are the responsibility of the consumer. We do not deliver items to P.O. boxes.

Deliveries are not made on Saturdays or Sundays or on bank holidays in each particular region. All items purchased from DOWNTOWN GRILL INC. are sent through recognized delivery companies.

In order to prevent problems with deliveries (incorrect address, not finding anyone at the address), the corresponding form must be filled in correctly, especially the box with a contact telephone number.

Once your order has left our warehouse, you will be sent an e-mail providing you with the parcel tracking number assigned by the courier company responsible for delivering your item(s). You will be then able to track your order.

All items delivered by DOWNTOWN GRILL INC. remain our property until DOWNTOWN GRILL INC. has received your payment.

Cancellation of orders

You may cancel your order at any time before it has been sent and receive a full refund. If your order has been sent (i.e. has already left our warehouses), you will have to wait until it is delivered to you before you can cancel the order, although such cancellation is subject to certain terms and conditions (see “Returns and exchanges”).

Returns and exchanges

If you are not satisfied with your purchase, you have a period of 30 days from the date of receipt to return or exchange the item(s). In order to return or exchange an order, you must check that it meets the following criteria:

Returns

To request the return of an item, please contact our customer service department.

If the item is returned as a result of a manufacturing default or quality issue for which DOWNTOWN GRILL INC. is responsible, we will refund the entire amount paid within 10 working days. The refund will be made automatically to the credit card used by the customer.

Cash on delivery returns will not be accepted under any circumstances.
